Terms of Service

These Terms of Service govern access to and use of the Next Gen FX (“NGF”) website, TradingView indicators, member features, community services, live sessions, Trading Journal, market and investment content, Personal Trading Plan and related products or services.

1. Acceptance of these terms

By purchasing, accessing or using an NGF product or service, you agree to these Terms, the Risk Disclaimer, Privacy Policy and Subscription & Cancellation Policy. If you do not agree, do not use the service.

2. Eligibility and lawful use

You must be legally capable of entering into a binding agreement and using the relevant financial-market tools in your jurisdiction. You are responsible for ensuring that your use of NGF, TradingView, your broker and any financial product is lawful where you live.

3. What NGF provides

NGF provides TradingView decision-support indicators and may provide optional services such as community access, live trading education, market and investment commentary, a Trading Journal and Personal Trading Plan services. Features can evolve over time.

4. No financial advice and no performance guarantee

NGF does not guarantee profits, winning trades, target hit rates, future returns or account growth. NGF content is educational and analytical and does not replace independent judgment. You remain responsible for all trading, investing and risk-management decisions. The NGF Risk Disclaimer forms part of these Terms.

5. Limited personal license

Unless NGF expressly agrees otherwise in writing, purchases grant the customer a limited, personal, non-exclusive, non-transferable and revocable right to use the purchased NGF service while the relevant access remains active. No ownership of NGF software, indicator logic, source code, content, branding or intellectual property is transferred.

6. Accounts and access

You are responsible for providing accurate account information and keeping login credentials secure. Paid access is for the purchasing customer. You must not share customer-account credentials or restricted access with unauthorized third parties.

TradingView indicator access may require the customer to provide the correct TradingView username. Incorrect usernames can delay access. At launch, some TradingView access may be granted or removed manually by NGF.

7. Subscriptions and billing

NGF indicator plans and selected add-ons are monthly recurring subscriptions unless the checkout clearly states otherwise. There is no free trial at launch. The amount and billing frequency are displayed before payment. By completing a recurring checkout, you authorize recurring charges until cancellation.

Current launch pricing is described in the Subscription & Cancellation Policy and at checkout. If prices differ, the amount presented and accepted at checkout controls for that purchase, subject to applicable law.

8. Add-ons and one-time services

Optional add-ons can carry separate recurring charges. The NGF Personal Trading Plan is a one-time service at the price shown at checkout and is not a recurring subscription unless expressly stated otherwise.

9. Cancellation, failed payments and access expiry

Cancellation rules, failed-payment handling, access expiry and refund information are described in the Subscription & Cancellation Policy. NGF may suspend paid access when a payment fails, a subscription expires or a charge is reversed, subject to applicable law.

10. Intellectual property

NGF and its licensors retain all rights in NGF names, logos, website design, written content, indicators, scripts, code, scoring systems, dashboards, proprietary workflows, graphics, training materials and other intellectual property.

You may not copy, resell, sublicense, redistribute, publish restricted material, extract or reproduce proprietary indicator logic, reverse engineer protected software, circumvent access controls or make NGF paid content available to unauthorized users except where a right cannot legally be restricted.

11. Acceptable use

You may not use NGF to violate law, interfere with service operation, probe or attack systems, automate abusive requests, impersonate another person, commit fraud, distribute malware, scrape protected member content at scale or evade membership restrictions.

12. Community and live-session conduct

NGF may remove content or restrict community access for harassment, spam, fraud, unlawful conduct, credential sharing, abusive behavior or material violations of these Terms. Community users are responsible for their own statements. Participation does not create an advisory relationship.

13. Third-party services

NGF may rely on third-party services including TradingView, Stripe, Shopify, hosting, database, communications and market-data providers. Your use of those services can also be subject to their terms. NGF does not control their availability, policies, prices or technical operation.

14. Changes, maintenance and product updates

NGF may update indicator logic, interfaces, content, features, infrastructure and workflows for security, reliability, compliance, product development or other legitimate reasons. Updates do not imply or guarantee better trading performance.

15. Availability

NGF does not promise uninterrupted or error-free operation. Maintenance, internet failures, platform outages, market-data problems, software defects and circumstances outside NGF’s reasonable control can affect availability.

16. Disclaimers

To the maximum extent permitted by applicable law, NGF services are provided without guarantees regarding profitability, trading accuracy, fitness for a particular trading objective, uninterrupted availability or future market performance. Mandatory consumer rights remain unaffected.

17. Limitation of liability

To the maximum extent permitted by applicable law, NGF will not be liable for trading losses, investment losses, lost profits, lost opportunities, losses caused by market movements or third-party execution, or indirect or consequential losses arising from a user’s trading or investment decisions. Nothing in these Terms limits liability that cannot legally be limited.

18. Suspension or termination

NGF may suspend or terminate access for material breach of these Terms, non-payment, fraud, abuse, unauthorized sharing, security threats or unlawful use. Where appropriate and required by applicable law, notice or an opportunity to remedy will be provided.

19. Mandatory consumer rights

Nothing in these Terms removes statutory rights that cannot be waived. If a mandatory law gives you stronger rights than a provision in these Terms, that mandatory law applies to the extent required.

20. Changes to these Terms

NGF may update these Terms as the service changes. The current version will be posted on this page with an updated date. Material changes will be handled in accordance with applicable law.

21. Severability

If a provision is found unenforceable, the remaining provisions continue to apply to the extent legally permitted.
